Welcome to Definite Designer

Bug Media LLC is a digital media company (company number 88-4293478, registered office at Kagan, Stern, Marinello & Beard, LLC - 238 West Street, Annapolis, Maryland 21401) that owns and operates Definite Designer, a fashion design game application (the "App") available in the Apple App Store and Google Play Store (hereinafter referred to as "we," "us," "our," or "Bug Media").

Definite Designer allows users to describe fashion outfits in words and see them generated as images using AI technology. Users can save their designs, display them in a virtual boutique, and earn virtual currency through simulated sales (the "Services").

By using the App or accessing any content or material made available by Bug Media, you understand and agree to accept and adhere to the following terms and conditions.

1. Accessing the Services

In order to access our Services, you confirm that you have read these Terms. Whenever you use our Services, you acknowledge that you understand and agree to these Terms, and you also agree to our Privacy Policy.

We may make changes to our Terms from time to time. We will publish all changes on this page with the date these amendments are made. Your continued use of our Services after any amendments constitutes your acceptance of any such amendments.

If you do not agree to comply with these Terms, please do not access or continue to use our Services.

By using our Services, you confirm that:
(i) You are at least 9 years old. Users younger than 18 should have permission from a parent or legal guardian, who will take responsibility for compliance with these Terms;
(ii) You have read, understood, and agree to be bound by these Terms.

2. Parental Consent

Definite Designer is designed for users ages 9 and up. If you are under 18 years old:

• You should have your parent or guardian review these Terms with you
• Your parent or guardian is responsible for your use of the App
• In-app purchases require passing a parental gate (solving a math problem)
• We recommend parents enable device-level parental controls

3. Acceptable Use

When using Definite Designer, you agree to:

• Use the App only for its intended purpose of creating fashion designs
• Not attempt to generate inappropriate, offensive, or harmful content
• Not attempt to bypass our content filters or safety measures
• Not attempt to access the App through unauthorized means
• Not attempt to reverse engineer, modify, or tamper with the App
• Not use the App to violate any laws or regulations

We reserve the right to suspend or terminate access for users who violate these terms.

4. Content Guidelines

When creating design descriptions, you must not attempt to generate content that:

• Is sexually explicit, violent, or inappropriate for all ages
• Depicts illegal activities
• Infringes on intellectual property rights
• Contains hate speech or discriminatory content
• Attempts to create realistic images of real people

We have automated filters in place to block inappropriate content. Repeated attempts to bypass these filters may result in account suspension.

5. AI-Generated Content

The fashion images in Definite Designer are generated using artificial intelligence. You understand and agree that:

• AI-generated images may not always match your exact description
• Results may vary and we cannot guarantee specific outcomes
• Generated images are for personal entertainment use only
• You may not use generated images for commercial purposes without permission
• AI technology has limitations and may occasionally produce unexpected results

6. In-App Purchases

Definite Designer offers optional in-app purchases for design generation credits:

• Free users receive 3 design generations per day
• Additional generations can be purchased in packs
• Purchases are processed through Apple App Store or Google Play Store
• Generation credits are consumable and do not expire
• A parental gate is required before accessing the purchase screen

Refund Policy

All purchases are handled by Apple or Google. Refund requests must be submitted through the respective app store. Once generation credits have been used, they cannot be refunded. For unused credits, refund eligibility is determined by Apple or Google's policies.

7. Virtual Currency and Game Progress

The virtual money earned in the boutique simulation has no real-world value and cannot be:

• Exchanged for real currency
• Transferred to other users
• Used outside of the App

Game progress is stored locally on your device. We are not responsible for lost progress due to device changes, app deletion, or technical issues.

8. Intellectual Property

All content in Definite Designer, including but not limited to the app design, graphics, user interface, code, and the Definite Designer name and logo, are owned by Bug Media LLC and are protected by intellectual property laws.

AI-generated images created through the App are provided for your personal use. You retain the right to use images you create for personal, non-commercial purposes.

9. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information. By using the App, you agree to our Privacy Policy.

10. Disclaimer of Warranties

The Services are provided "as is" without warranties of any kind, either express or implied. We do not guarantee that:

• The App will be available at all times without interruption
• The App will be free from errors or bugs
• AI-generated images will meet your specific expectations
• Your game progress will never be lost

We strive to provide a reliable service but cannot guarantee uninterrupted availability.

11. Limitation of Liability

To the fullest extent permitted by law, Bug Media LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to:

• Loss of game progress or virtual currency
• Dissatisfaction with AI-generated images
• Inability to access the Services
• Unauthorized purchases (parents should enable device controls)

12. End User License Agreement (EULA)

12.1 License Grant

Subject to your compliance with these Terms, we grant you a limited, personal, non-transferable, non-sublicensable, worldwide, and non-exclusive license to use the App for your own personal, non-commercial use.

12.2 Restrictions

You may not: copy, modify, or create derivative works of the App; reverse engineer, decompile, or disassemble the App; sell, rent, lease, or sublicense the App; or use the App for any commercial purpose.

12.3 Apple App Store Terms

If you downloaded the App from the Apple App Store, you acknowledge that: (i) these Terms are between you and Bug Media, not Apple; (ii) Apple has no obligation to provide maintenance or support; (iii) Apple is a third-party beneficiary of these Terms.

13. Termination

We may suspend or terminate your access to the Services at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.

You may stop using the Services at any time by deleting the App from your device.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes by updating the "Last updated" date. Your continued use of the App after changes constitutes acceptance of the modified Terms.

15. Governing Law

These Terms are governed by the laws of the State of Maryland, United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts located in the State of Maryland.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
